The popular American rock band The Black Keys told a judge last week that they have settled their copyright infringement lawsuits against Home Depot and Pizza Hut over the misuse of their music in commercials.
The lawsuit claimed that their song “Gold on the Ceiling was improperly used to sell pizza, and the track “Lonely Boy” was used to sell power tools for Home Depot.
Early court filings by the band said that the commercials were, “a brazen and improper effort to capitalize on the plaintiff’s hard-earned success”
The Grammy-award winning band along with producer Danger Mouse sued in June with both companies claiming they did not copy the songs . The details of the settlement have not been made public with none of the parties commenting on the terms.
The initial suit consisted of band members Dan Auerbach and Patrick Carney seeking damages of upwards of $75,000 as well as an order to discontinue the use of the songs in the ads, which include no vocals, and a different production “sound”.
Formal dismissals of the case are expected to be filed in January, according the Associated Press.
